Islamic Law: Girls Can Be Married Even ‘In The Cradle’

…Fawzan insisted that nowhere does Sharia (or Islamic law) set an age limit for marrying girls: like countless Muslim scholars before him, he relied on Koran 65:4, which discusses marriage to females who have not yet begun menstruating (i.e., are prepubescent) and the fact that Muhammad, Islam’s role model, married Aisha when she was six or seven, “consummating” the marriage—or, in modern/Western parlance, raping her—when she was nine.

The grand point of the Saudi fatwa, however, is not that girls as young as nine can be married, based on Muhammad’s example, but rather that there is no age limit whatsoever.  The only question open to consideration is whether the girl is physically capable of handling her “husband.”  Fawzan documented this point by quoting Ibn Battal’s authoritative exegesis of Sahih Bukhari:

The ulema [Islam’s scholars and interpreters] have agreed that it is permissible for fathers to marry off their small daughters, even if they are in the cradle.  But it is not permissible for their husbands to have sex with them unless they are capable of being placed beneath and bearing the weight of the men.  And their capability in this regard varies based on their nature and capacity.  Aisha was six when she married the prophet, but he had sex with her when she was nine [that is, when she was deemed capable].

Fawzan concluded his fatwa with a warning: “It behooves those who call for setting a minimum age for marriage to fear Allah and not contradict his Sharia, or try to legislate things Allah did not permit.  For laws are Allah’s province; and legislation is his exclusive right, to be shared by none other.  And among these are the rules governing marriage.”

Once again, case closed.

Fawzan, of course, is not the first to insist on the legitimacy of pedophilia in Islam.  Nor is this just some theoretic, abstract point; the lives of countless young girls are devastated because of this teaching.  Recall, for instance, the8-year-old girl who died on her “wedding” night as her “husband” raped her; or the 12-year-old who died giving birth to a stillborn; or the 10-year-old who made headlines by hiding  from her 80-year-old “husband.”…

Was Muhammad a Pedophile?

…Nevertheless, Muslims are too hasty in dismissing objections to Muhammad’s relationship with Aisha. When Muslims tell us to convert to Islam, we can’t simply ignore their prophet’s marriage to a nine-year-old girl. Muslims view Muhammad as the highest example of a moral life, but his marriage to Aisha conflicts with that view. If they want to put Muhammad forward as the pattern of conduct for all humanity, Muslims need to come to terms with the many questionable things he did, as well as the catastrophic impact of his actions.

There is, of course, a simple (but highly explicit) way to evaluate the importance of Muhammad’s marriage to Aisha. We must begin by trying to get a mental picture of a morally perfect man. For Muslims, this will include all the things they have been taught about Muhammad. According to their picture, he is kind, generous, patient, humble, and trustworthy. He protects orphans and widows, endures persecution, helps the needy, and promotes justice. He prays faithfully, fasts regularly, and obeys God in everything. He is loyal to his friends and patient with his enemies. He never gives in when tempted with evil. Now we must picture this same man in a room with an innocent little girl. He takes away her doll, climbs on top of her, and forces his penis inside her. She doesn’t know what is happening because she is too young to know much about sex. Frightened and confused, she cries because of the pain and bleeds on her bed, but she tries to remain quiet out of respect for her new husband, who, in return, endangers her life.

If a person is able to keep the same vision of moral perfection throughout this description, he may have the faith necessary to be a Muslim. But if his vision of the perfect man is at odds with what Muhammad did on numerous occasions, he will need to look elsewhere for an ideal human being.

Yes, There Is a Link between Islam and Paedophilia

….It seems hard to believe that Islam has no problem with paedophilia if you don’t know that Muhammad, who is for Muslims the ideal man, the “perfect example”, the supreme example of conduct, the model to follow and imitate, just as Jesus is for Christians, was indeed a paedophile. He married Aisha, one of his wives, when she was 6 and had complete sexual intercourse with her when she was 9.

The argument that in those times the law and public moral code were different is irrelevant here. First of all, a religion, to be worthy of that name, must give ethical guidance and directions. The self-proclaimed founder of a new religion who passively follows the diktats of contemporary mores without questioning them, without having a vision for the future – as Jesus Christ did, whose ethics is modern and in fact pioneering even today, after 2 millennia, does not deserve the title of prophet and his is not a religion.

Secondarily, that argument must be overturned. Paradoxically, saying that Muhammad just followed the rules of his day not only gives him and his pseudo-religion the coup de grace, but also encapsulates in one sentence what is wrong with Islam: a 7th-century AD warlord who was simply a slave of his time, killing, slaughtering, having multiple wives, having sex with children, was no better and no worse than many others of his contemporaries; but what has made him so perverse, as Robert Spencer has pointed out, is that he enshrined all these terrible behaviours into moral guidelines for the posterity, so that what could have been consigned to history long time ago, barbarism, gratuitous violence, oppression of women, paedophilia — among his other abominable activities –, has now been set in stone for all future generations to obey to and adopt as an ideal way to conduct one’s life….
