Legal Challenge Exposing Massive CAIR Fraud Scheme Awaiting Judge’s Ruling; Jury Trial Expected

Yesterday, the American Freedom Law Center (AFLC) and the Law Offices of David Yerushalmi, P.C. filed its reply brief in support of its motion for summary judgment in the United States District Court for the District of Columbia on behalf of five former clients of the Council on American-Islamic Relations (CAIR), who had earlier filed two separate lawsuits in federal court against CAIR, alleging common law and statutory fraud, breach of fiduciary duty, and intentional infliction of emotional distress.

 

CAIR, a self-described Muslim public interest law firm, was previously named as a Muslim Brotherhood-Hamas front group by the FBI and the U.S. Attorney’s Office in the federal criminal trial and conviction of a terrorist funding cell organized around one of the largest Muslim charities, the Holy Land Foundation (HLF).  HLF raised funds for violent jihad on behalf of Hamas, and top CAIR officials were part of the conspiracy.  In addition, several of CAIR’s top executives have been convicted of terror-related crimes.  As a result, the FBI publicly announced that it has terminated any outreach activities with the national organization, which bills itself as “America’s largest Muslim civil liberties and advocacy organization.”

 

These two lawsuits, which were consolidated by the court because they arise out of the same facts, follow an earlier lawsuit that had also alleged that CAIR’s fraudulent conduct amounted to racketeering, a federal RICO crime.  In that case, the court dismissed the RICO counts, concluding that CAIR’s conduct as alleged was fraudulent but not a technical violation of RICO.

 

The pending lawsuits allege that Morris Days, the “Resident Attorney” and “Manager for Civil Rights” at the now defunct CAIR-MD/VA chapter in Herndon, Virginia, was in fact not an attorney and that he failed to provide legal services for clients who came to CAIR for legal representation.  As alleged, CAIR knew of this fraud and purposefully conspired with Days to keep the CAIR clients from discovering that their legal matters were being mishandled or not handled at all.  Furthermore, the complaints allege that according to CAIR internal documents, there were hundreds of victims of the CAIR fraud scheme.

 

According to court documents, CAIR knew or should have known that Days was not a lawyer when it hired him.  But, like many criminal organizations, things got worse when CAIR officials were confronted with clear evidence of Days’ fraudulent conduct.  Rather than come clean and attempt to rectify past wrongs, CAIR conspired with Days to conceal and further the fraud….

 

….“What is unique about this case,” Yerushalmi added, “is that there is a good chance that the judge, who now understands the abusive legal tactics used by CAIR, could rule in our favor on liability and the jury will only be asked to decide how much CAIR must pay its victims.”

 

Robert Muise, AFLC co-founder and senior legal counsel, added, “The evidence in this case will finally put to rest the myth that CAIR is a legitimate Muslim American civil rights organization when in fact it is little more than an agent of the Muslim Brotherhood and a recipient of huge donations from operatives of the Organization of the Islamic Conference (OIC).”

 

The complaint also alleges that in addition to covering up the fraud scheme, CAIR forced angry clients who were demanding a return of their legal fees to sign a release that bought the client-victims’ silence by prohibiting them from informing law enforcement or the media about the fraud.  According to the agreement, if the “settling” clients said anything to anyone about the fraud scheme, CAIR would be able to sue them for $25,000.  This enforced code of silence left hundreds of CAIR’s victims in the dark such that to this day, they have not learned that Days was not an attorney and that he had not filed the legal actions on their behalf for which CAIR publicly claimed credit.  Days has since died of a lung complication.

 

Mr. Yerushalmi concluded, “Why this organization is allowed to exist as a non-profit, tax-exempt organization at all is mind-boggling.”

Lego accused of racism with Star Wars set

The anger was provoked by “Jabba’s Palace”, a model from Lego’s Star Wars product range based on the series of Star Wars films

Austria’s Turkish community said the model was based on Hagia Sophia mosque in Istanbul and that the accompanying figures depicted Asians and Orientals as people with “deceitful and criminal personalities.”

The Turkish Cultural Community of Austria released a statement calling for Lego to apologise for affronting religious and cultural feelings.

The anger was provoked by “Jabba’s Palace”, a model of the home of Jabba the Hutt from Lego’s Star Wars product range based on the blockbusting series of science fiction films.

Jabba is the large slug-like creature who holds Han Solo captive in the film Return of the Jedi, and his palace is the setting for several crucial scenes, including using Princess Leia as his slave.

Jabba’s domed home and accompanying watchtower bare, according to the statement, an unwanted resemblance to Istanbul’s great Hagia Sophia, and another mosque in Beirut….

….Austria’s Turkish community also took issue with the figures that went with the palace, including Jabba.

“The terrorist Jabba the Hutt likes to smoke a hookah and have his victims killed,” said the statement posted on the organisation’s website.

“It is clear that the ugly figure of Jabba and the whole scene smacks of racial prejudice and vulgar insinuations against Asians and Orientals as people with deceitful and criminal personalities.”

The crimes associated with the figures, the statements adds, include terrorism, slavery, murder and human sacrifice…. (That sounds awfully familiar… -ed.)

Muslim Congress calls for Houston protest of film

“The Muslim Congress and Canadians Against Blasphemy have called for peaceful protests beginning at 2:30 p.m. Saturday across from the American consulate on University Avenue. Similar protests are also planned in Washington D.C., Houston and Los Angeles.

“We urge believers of all faiths and people to come out and express their opposition to the vulgarity, hate mongering, lies and insult of sacred beliefs that hurt sentiments of all believers in monothesim [sic]” says a flyer being distributed to announce the protest.

On a post on the group’s website, the Texas-based Muslim Congress calls the film and its contents a great sin and a blasphemous act.

“For decades, Zionist and Islamophobic hate-mongers within the United States have disrespected Divine personalities in general, and the personality of the Holy Prophet Muhammad,” says the post on the website.”

Sharia in USA: NY: Hamas-CAIR trying impose Shariah compliant Blasphemy Laws – Free Speech not permitted for non-muslims

Brave, fearless and intrepid Pamela Geller is letting us know that Hamas linked CAIR is putting pressure on New York mayor Bloomberg and the Metropolitan Transit Authority of New York to condemn ads being run by Geller’s American Freedom Defense Initiative as being anti-muslim hate speech.

Interesting there was no call by CAIR to ask the same people to denounce hate ads against Israel  . . .but then again when your are the US  arm of Hamas whose charter calls for the destruction of the State of Israel what do you expect.

Here we have another clear attempt by muslims to implement Shariah Law in America by stifling the free speech rights of Americans because muslims find the message offensive. Sorry CAIR we live under the Laws or America not the las of the koran

Here is the AFDI ad (it calls jihadis savages – a correct dictionary definition based on the actions of jihadis) No mention of muslim anywhere.

More drivel from the Houston Chronicle – Paints Muslims as Victims and Ignores Radical Fatwas from Local Imam

Our friend Pamela Geller at Atlas Shrugs reminded us that yesterday saw yet  another article by our hometown Dhimmi rag, the Houston Chronicle that  panders to Muslim causes.

Chronicle reporter Lomi Kriel wrote about the attempts by congregants of an Islamic Society of Greater Houston mosque to “fire” their Imam after he made some bizarre, weird and totally nutty statements claiming the U.S. government was poisoning the drinking water and other loopy stuff.

Now if members of any religious denomination want to rid themselves of a Pastor, Preacher, Rabbi or Imam for being loopy loo that is their right, but Kriel decided to take this story way off base and as a consequence filled readers heads with inaccurate and incomplete information full of Islamic propaganda and victimhood narrative.

For example, Kriel emphasized members of the mosque want to speak out against those who are “blots in their community” but then failed to mention that ISGH is one of those blots, not because they have a nutty Imam, but because they are part of the Islamic Society of North America, an un-indicted co-conspirator in the Holy Land Foundation, Hamas terror funding case.

Citing unnamed experts, Kriel contends that “young Muslims in particular  . . . feel the need to self-police their own community’ but fails to inform readers that there was no self-policing going on when the President of the ISGH  conducted an on camera interview with a local news station in which he denied the attacks of 9/11 were carried out by Muslims, or when a 2005 report on Hate in US Mosques uncovered several Houston area mosques operated by ISGH where hate literature had been found.

Kriel did not share with readers that the Muslim organization sought for a comment on this story is Hamas linked CAIR, also an un-indicted co-conspirator in fund raising for Hamas, or that it’s Director quoted i nthe article, Mustafa Carroll is another 9-11 truther, and advocates for Sharia law to replace the U.S. Constitution.

The Chronicle did however pad the story with how this group of Muslims, disgruntled with their Imam and already suffering as victims of post 9/11 anti-Islam backlash have now found their voice to speak out against “fringe comments” which in turn has helped prevent terror attacks.

The journalistic ineptitude is staggering.

What backlash against Muslims  . . . ?   FBI hate crime stats suggest otherwise.

The Chronicle would have us believe that Houston Muslims speak out against “fringe comments” made by their paranoid and nutty Imam, and that now means terror attacks have been foiled?

Really . . . . ?

We challenge the Houston Chronicle to ask these same Muslims, when will you speak out against the “fringe comments” about jihad, sharia, Islamic Jew-hatred etc. regularly heard in many mosques up and down the country.

Pamela Geller reminds us in her post

According to a recent five-year survey of mosques in America, over 80% are teaching, promoting and advancing jihad. We never hear Muslims express concern or complain about that rhetoric. This story only confirms our worst fears of what goes on in the mosques. Only when Muslims speak out against jihad, honor killlings, FGM, and the sharia can we begin to hope that the essential change needed in Islam is beginning to actually happen.

We have to wonder why is the Houston Chronicle not shining a light on the “fringe comments” issued by Main Alqdua, Imam at the Muslim Brotherhood controlled mosque in Katy, just west of Houston ?

Alqdua penned a 2010 fatwa declaring it a sin for US Troops to be in Muslim Lands (Iraq and Afghanistan) and therefore it is also forbidden for American Muslims to send care packages to them. He sits on the fatwa committee of the Assembly of Muslim Jurists of America who regularly issue Anti-American fatwas such as a 2010 instruction for American Muslims not to support or co-operate with Law Enforcement that is not based on Shariah and a more recent edict that called Female Genital Mutilation an honor and obligation for American Muslima

We call those type of comments “fringe” and should be challenged, but apparently Houston’s Muslims don’t because they havent spoken out about it, nor does the Houston Chronicle because they continue to refuse to write about it.
